White & Case invites you to participate in a unique seminar series on the challenges of regulating artificial intelligence from the viewpoint of four jurisdictions: Japan, the EU, China, and the United States. Policymakers, researchers and leading tech executives are calling for regulation and guardrails to mitigate the negative aspects of AI even as the "godfathers" of generative AI (Geoffrey Hinton, Yoshua Bengio and Yann LeCun) disagree about the potential threat to humanity. AI provides many benefits but there are risks and harms as well. Social justice, fairness and freedom from bias are some of the values that can be compromised by the emergent capabilities of AI, so it is incumbent on all members of society, including senior management at companies, to engage in the debate over the purpose and scope of the forthcoming regulations.
The global response to these issues will impact the future of business for years to come. China enacted legislation that took effect August 15, 2023, and the EU will enact legislation in the near future. Their respective approaches to regulation are, however, radically different. Japan and the U.S. also will likely soon follow with regulations, where the public statements to date suggest they are attempting to strike a balance between avoiding harm and promoting innovation.
Companies doing business globally need to consider:
- What policy alternatives are being discussed?
- Who should regulate and what should they focus on?
- What technical solutions are available to manage the risks?
- What companies need to do in connection with consumer protection, data privacy and cybersecurity?
- How intellectual property can be protected?
- What is the impact of the different regulatory models on businesses?
The discussions will be moderated by Arthur M. Mitchell and David Albagli.
Moderators
David Albagli, PhD is a Local Partner in White & Case's Global Intellectual Property Practice, based in Tokyo. His practice focuses on intellectual property spanning patent litigation, prosecution, opinion work, patent portfolio development, pre-litigation counseling, and due diligence investigations, as well as trademarks, technology transactions, and license agreements. Dr. Albagli advises on a wide range of intellectual property and transaction-related matters in the pharmaceutical, chemical, and biotechnology sectors.
Arthur Mitchell has over 47 years of experience, much of it in Asia and is one of the leading American lawyers specializing in financing transactions around the world. He spearheaded the creation of the Digital Transformation (DX) & Green Transformation (GX) Webinar Series in order to provide senior business leaders with insights into business, policy and legal issues related to emerging technologies. Arthur is a member of various professional associations including the Council on Foreign Relations, Sustainability Committee, American Chamber of Commerce in Japan (ACCJ), former member of the Board of Directors, Sumitomo Mitsui Financial Group, Inc., and currently a Director at Komatsu Ltd. He is and a regular speaker at industry conferences and is the author of numerous articles on legal developments in Asia and beyond.
