Digital Transformation & Green Transformation Seminar Series – Fall 2023

White & Case invites you to participate in a unique seminar series on the challenges of regulating artificial intelligence from the viewpoint of four jurisdictions: Japan, the EU, China, and the United States. Policymakers, researchers and leading tech executives are calling for regulation and guardrails to mitigate the negative aspects of AI even as the "godfathers" of generative AI (Geoffrey Hinton, Yoshua Bengio and Yann LeCun) disagree about the potential threat to humanity. AI provides many benefits but there are risks and harms as well. Social justice, fairness and freedom from bias are some of the values that can be compromised by the emergent capabilities of AI, so it is incumbent on all members of society, including senior management at companies, to engage in the debate over the purpose and scope of the forthcoming regulations.

The global response to these issues will impact the future of business for years to come. China enacted legislation that took effect August 15, 2023, and the EU will enact legislation in the near future. Their respective approaches to regulation are, however, radically different. Japan and the U.S. also will likely soon follow with regulations, where the public statements to date suggest they are attempting to strike a balance between avoiding harm and promoting innovation.

Companies doing business globally need to consider:

• What policy alternatives are being discussed?
• Who should regulate and what should they focus on?
• What technical solutions are available to manage the risks?
• What companies need to do in connection with consumer protection, data privacy and cybersecurity?
• How intellectual property can be protected?
• What is the impact of the different regulatory models on businesses?
