Rachael Stowasser
Biography
Overview
Rachael Stowasser is an associate in the Firm's Global Antitrust/Competition practice group based in Sydney.
Rachael advises clients on merger control, joint ventures, exclusive dealing, complex regulatory investigations, enforcement matters and misleading and deceptive conduct litigation in the Federal Court of Australia. She has particular expertise in the technology and retail sectors.
Rachael has a broad commercial litigation background, with a particular emphasis on competition and consumer law and regulatory investigations. She has considerable experience in acting for medium to large private and public corporations and local government authorities in litigious disputes in the Federal Court of Australia and the Supreme and District Courts of Queensland.
Rachael holds an LLM degree with distinction from the London School of Economics and Political Science, where she specialised in competition, innovation and trade law, with a particular focus on the technology sector. She previously served as a Judge's Associate in the District Court of Queensland and holds a Bachelor of Laws (Hons) and a Bachelor of Economics from the University of Queensland.
Experience
Representative experience includes advising:
- A corporation on competition clearance of its acquisition in an increased stake in Papua New Guinea LNG operations.
- A corporation established by way of joint venture on competition risks associated with the release of a new service offering.
- A major Australian retailer in proceedings brought against it by the ACCC for alleged false or misleading claims about its 'Anti-virus Activewear', in breach of Australian Consumer Law.*
- A local government body in proceedings brought against it by a listed company in the Federal Court of Australia for damages for misleading and deceptive conduct under the Australian Consumer Law and negligent misstatement at common law.*
- An insurer in proceedings brought against the insured in the Federal Court of Australia for claims for damages for misleading and deceptive conduct under the Australian Consumer Law and negligence at common law.*
