Globalization Reshaped: A New Paradigm Emerges

The workings of the globalized economy that shaped our worldview and informed our strategies, has been steadily shifting since the 2007-2008 Global Financial Crisis. Whereas a relatively open form of globalization fostered cross-border flows of goods, services, capital, people, and data, there is now concern that the world is on a path towards a division between two distinctly different camps. Reality is likely, however, to be more nuanced. A close analysis undertaken by our firm of new legal frameworks around the world reveals that a world of "clubs" and "fences" is emerging. Clubs form among countries within sectors that harmonize their regulations. The result is business activity for these sectors that is more predictable and generally smooth. Fences, on the other hand, are erected when regulatory barriers are adopted that tend to slow or block business activity. Collectively, these changes mark a significant shift in the way regulation impacts global interconnectedness, with important implications for global businesses.

Geopolitical factors are driving business decisions more than has been the case for decades. Restrictions on inbound and outbound investments are increasing, with a view to fostering economic and national security, and the implications are obvious for technology companies. At the same time, some countries are forging closer relationships to decrease costs and ensure access to resources for like-minded members.
